Terms and Conditions for code.fun.do++


The following ‘Terms and Conditions’ shall apply to the Microsoft Academia Accelerator code.fun.do++ Challenge (hereinafter referred to as the “Challenge”). Level 1 of the Challenge shall begin on September 29, 2018 and continue till October 26th. Winning team from each college (1 team only) will be invited to participate in code.fun.do++ National Challenge in February 2019. More details on the National Challenge will be published in January 2019.

Microsoft India (R&D) Pvt. Ltd. (hereinafter referred to as “Microsoft”) has organized this Challenge and reserves the right to curtail or extend the Challenge Period.

The Challenge is restricted to the students (hereinafter referred to as the “Participant” or the “Participants”) enrolled with the following colleges of India during the current academic year, in any discipline.

A Participant must be 18 years of age or older. Minors must have consent of a parent or legal guardian to be able to participate.

To participate in the Challenge, a Participant will have to form a Team or join an existing team. A team can have a maximum of three participants, all of whom must be from the same college.

This is a binding legal agreement between Microsoft and the Participant regarding participation in the Challenge and no Participant shall be eligible to participate in the Challenge unless they have agreed to these Terms and Conditions.

Participation in the Challenge shall be construed as an acceptance of these Terms and Conditions. Any breach or default by a Participant of any of these Terms and Conditions can result in immediate disqualification of the concerned Participant without notice, in addition to any consequences that may entail as a result of the law for the time being in force.

Challenge Format & Description

The problem statement defined in the Challenge can be https://codefundo.io Entries which do not solve the defined problem statement will be deemed invalid.

The Challenge will be conducted as follows:

  • Participants will register on the contest website by October 05, 2018 with all requisite details that would be asked of them. During this time, participants can form teams with up to 3 members or join a team.
  • A team can have a maximum of three participants.
  • Members of a team must all be from the same college.
  • A participant can only be part of one team during the entire course of the Challenge.
  • Switching between teams at any point of the Challenge is not allowed and will lead to disqualification of the Participant and the Team. Any attempt by a participant to be part of more than one team either by using multiple/ different accounts, identities, registrations, logins, or any other methods will void the participant’s entry and lead to disqualification.
  • One team can submit only one entry at each phase (see below for list of phases) of the Challenge.
  • Use of any automated system to participate is prohibited.
  • Microsoft is not responsible for excess, lost, late, or incomplete entries. If disputed, entries will be deemed submitted by the “authorized account holder” of the email address, social media account, or other method used to enter. The “authorized account holder” is the natural person assigned to an email address by an internet or online service provider, or other organization responsible for assigning email addresses.

Level 1 of the Challenge will progress through phases as follows:

  • Microsoft reserves the right to make changes in phases / timelines / dates at any given point during the Challenge.
  • Adherence to the completion parameters of a phase is mandatory for a team to progress to the next phase. Microsoft’s decision in this regard will be final.
  • Microsoft mentors or tech partners (“Mentor”) will be available to guide teams during the course of the Challenge, but participants will be solely responsible for their teams’ performance during all the phases of the Challenge.

Judging Panel

The Challenge will be judged by a Jury (“Jury”) comprising subject matter experts from Microsoft, Microsoft tech partners, teaching faculty of participating colleges, etc.

In the event of a conflict of interest between the Participant and any member of the Jury, such member may recuse himself from passing judgment only on the concerned team or Participant, as the case may be.

Judging Criteria & Eligibility

To be eligible for the final round of judging, a team’s entry must meet the following content/technical requirements:

  • It should be original work.
  • For video entry, please note the video must be solely the work of the team, including but not limited to, the actual filming, editing, graphic design, etc. of the video.
  • The entry cannot have been selected as a winner in any other contest.
  • Team must have obtained any and all consents, approvals, or licenses required to submit the entry.
  • To the extent that entry requires the submission of user-generated contest such as software, photos, videos, music, artwork, essays, etc., teams warrant that their entry is their original work, has not been copied from others without permission or apparent rights, and does not violate the privacy, intellectual property rights, or other rights of any other person or entity.
  • Entry may NOT contain, as determined by us in our sole and absolute discretion, any content that is obscene or offensive, violent, defamatory, disparaging or illegal, or that promotes alcohol, illegal drugs, tobacco or a particular political agenda, or that communicates messages that may reflect negatively on the goodwill of Microsoft.

The jury will select the winning teams from among all eligible entries received at the end of phase 3 based on the following judging criteria:

  • 50%: Uniqueness of solution
  • 20%: Feasibility of solution
  • 15%: Relevance to Theme
  • 15%: Maximum impact to successful outcomes for the theme

Use of Azure, Microsoft AI technologies and Github is mandatory. Teams which use other Microsoft technologies will be preferred.

The decision on the Winners selected as per the criteria and process decided by Microsoft shall be final and binding and no complaints, correspondence or communication shall be entertained in this regard.

Participants of all teams that complete a phase will receive goodies.

Participants of all teams that have an eligible submission in Phase 3 will get Certificates.

Each participant of Winning team from each college (1 team per college) will get prize money of INR 20,000 (Rupees twenty thousand only).

Each participant of First Runner Up team from each college (1 team per college) will get prize money of INR 10,000 (rupees ten thousand only).

Each participant of Second Runner Up team from each college (1 team per college) will get prize money of INR 5,000 (rupees five thousand only).

Winning team from each college (1 team per college) will be invited to participate in code.fun.do++ National Challenge which will be held in February 2019. Participants will be invited to Microsoft to showcase their solutions to our leaders. Top 3 teams will be eligible to win cash prizes of up to INR 10,00000 (rupees ten lakhs only). More details of code.fun.do++ National Challenge will be published in January 2019.

The tax obligation on winning the cash prize will be borne by the participant. Microsoft shall withhold taxes and pay the balance prize amount. All participants who get cash prizes would need to obtain their PAN Card for claiming the Cash prize.

Prizes shall neither be transferable nor exchangeable. No other person or agent can claim the Prizes on behalf of the User. This Challenge cannot be clubbed with any other offer from Microsoft.

Rights and Obligations of Microsoft

Personal data provided by a Participant while entering this Challenge will be used by Microsoft and/or its agents and prize fulfillers acting on Microsoft’s behalf only for the administration and operation of this Challenge and in accordance with the Microsoft Privacy Statement.

Microsoft will not claim ownership rights to a Team’s submission. However, by submitting an entry, the Team will grant us an irrevocable, royalty-free, worldwide right and license to use, review, assess, test and otherwise analyze the entry and all its content in connection with this Challenge and use the entry in any media whatsoever now known or later invented for any non-commercial or commercial purpose, including, but not limited to, the marketing, sale or promotion of Microsoft products or services, without further permission from Participants/ Team. Participants/ Team will not receive any compensation or credit for use of the entry, other than what is described in these Official Rules.

By entering this Challenge, Participant acknowledges that Microsoft may have developed or commissioned materials similar or identical to the entry and Participant waives any claims resulting from any similarities. Further, participant understands that Microsoft will not restrict work assignments of representatives who have had access to the entry and participant agrees that use of information in our mentors’/ juries’ unaided memories in the development or deployment of Microsoft products or services does not create liability for Microsoft under this agreement or copyright or trade secret law.

An entry may be posted on a public website. Microsoft will not be responsible for any unauthorized use of the entry by visitors to this website. Microsoft is not obligated to use the entry for any purpose, even if it has been selected as a winning entry.

Microsoft does not make any commitment, express or implied, to respond to any feedback, suggestion and, or, queries of the Participants or furnish reasons for inclusion and, or, exclusion of any particular submission of the Participants at any stage of the Challenge.

Microsoft may assign any or all of its rights under these Terms and Conditions to its Affiliates without consent of the Participants.

The Participants agree to Microsoft’s use of their name, picture and other information submitted by them in any internal or external communications, press releases, videos, customer communications, etc.

Nothing in the Challenge shall affect any intellectual property rights of Microsoft in any product or service, which may be the subject matter of the Challenge.

Microsoft shall in no circumstances be responsible for paying any amount to the Participants including but not limited towards the costs of travel, lodging, etc., with respect to the Challenge or otherwise.

Microsoft reserves the absolute right to change the Terms and Conditions contained herein and, or, any other rules and regulations in respect of the Challenge at any time without any notice, without assigning any reason and without any liability whatsoever. Participants are requested to refer to such other terms and conditions, if any, which may be displayed on-line or intimated separately as Microsoft considers fit. However, no obligation is cast on Microsoft to separately intimate each individual Participants with regard to such additional terms and conditions.

Microsoft also reserves the right to withdraw or discontinue with the Challenge at any stage without any liability whatsoever to the Participant and, or, anyone.

Rights and Obligations of the Participant

The Participant undertakes and warrants that, for participating in the Challenge, they shall not use any unauthorized or pirated software and that their Entry shall be the Participant’s own original work which does not and will not infringe the intellectual property or proprietary rights of any third party, including, without limitation, any third party patents, copyrights, trademarks, trade secrets or confidential data. In the event any Participant is found to be doing so; the entry from such Participant shall forthwith be disqualified from the Challenge.

Any attempt by a Participant to

  • deliberately damage any website and/or
  • in relation to a computer, computer system, computer network or computer resource and without the permission of its owner,
  • secure access;
  • download, copy or extract any data or information;
  • introduce or cause to be introduced any computer contaminant or virus;
  • damage or cause damage, including to any data or data base therein;
  • disrupt or cause disruption;
  • deny or cause denial of access to any person who would otherwise be authorized to access;
  • provide any assistance to, or facilitate, any person to access who would otherwise not be authorized to access;
  • charge the services availed of by a person to the account of another person by tampering or manipulating;
  • destroy, delete, alter, diminish in value or utility and/or affect injuriously any information residing in such computer resource;
  • steal, conceal, destroy, alter or cause any person to steal, conceal, destroy or alter any computer source code with an intention to cause damage; and/or undermine the legitimate operation of the Challenge in any manner
is a violation of Criminal and Civil Laws and should such an attempt be made, Microsoft reserves the right to seek damages from any such Participant and initiate any other action to the extent permitted by law.

The Participant represents and undertakes that these Terms and Conditions or their participation in the Challenge, does not and shall not constitute a license, permission or consent by Microsoft, in any manner whatsoever, to access, exploit, communicate or otherwise use Microsoft’s intellectual property.

Ownership of all intellectual property rights in any Entry shall be retained by the Participant and nothing herein shall constitute an employment, joint venture, or partnership relationship between the Participant and Microsoft.

The Participant acknowledges and agrees that Microsoft may have developed, commissioned or may develop in the future, works which are similar to the Entry of the Participant or the Participant’s team, and the Participant waives any claims that they may have resulting from any similarities to the Entry of the Participant or the Participant’s team.

To the maximum extent permitted by law, the Participant agrees to defend, indemnify and hold harmless Microsoft and their parents, affiliates, subsidiaries, directors, officers, employees, sponsors and agents, from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or accruing from (i) any entry or other material submitted by the Participant that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property right of any person; (ii) any misrepresentation made by the Participant in connection with the Challenge; (iii) any breach of these Terms and Conditions; (iv) any act or omission on the part of the Participant committed during the course of their participation.

Limitation of Liability

In no event will Microsoft be liable to the participant or any other party for any direct, special, incidental, exemplary, punitive or consequential damages (including loss of use, data, business or profits) arising out of or in connection with the participant’s participation in the challenge, whether such liability arises from any claim based upon contract, warranty, tort (including negligence), strict liability or otherwise, and whether or not microsoft has been advised of the possibility of such loss or damage.

Applicable Law

The Challenge shall be governed by and construed in accordance with the laws of India and shall be subject to the exclusive jurisdiction of competent Court/s at New Delhi. Any disputes, differences and, or, any other matters in relation to and arising out of the Challenge and, or, pertaining to the rules and regulations and, or, the Terms and Conditions shall be settled by a process of binding arbitration in New Delhi.
